“Faster To the Ball” Competition Game Rules

Article I: Organisation
BABOLAT VS, a public limited company with board of directors and capital of 1,275,000 euro, registered with the Trade & Companies Registry of Lyon under number B 552 131 401, having its registered office at 93 rue André Bollier, 69007 Lyon, France, is organising a major game entitled “faster to the ball” from 00:00 on 21st February to 23:59 on 21 April 2011 (French Time).

Article II: Entry
Taking part in this free-to-play game with no obligation to purchase is open to all natural persons residing in France, Italy, Spain, U.K., U.S.A., Japan, Germany or Austria where local regulations are not in conflict with the rules below (with the exception of salaried employees and representatives of the organising company, its partners and subcontractors as well as their advisers and members of their families) and having access to an Internet connection and a valid e-mail address. Insofar as concerns persons not of full age (minors), they may play the game under the authority and with the authorisation of their legal representative, who must be able to prove he or she holds parental authority. In the eventuality of an under-age person’s entry being drawn and of his/her winning a trip to New York, he/she must obligatorily be accompanied by a person of full age. Entry is limited to one per person (same name, same address). Entries are strictly on a named basis only and on no account may a player play on behalf of other participants. Any game form that is incomplete, illegible, sent after the closing date or in any form other than that provided will be treated as null and void.

Article III: Terms
To take part, you just need to visit the following Internet address: www.fastertotheball.com and complete the game form. It is to be noted that only entries completed on www.fastertotheball.com will be taken into account.
Database used for the “Trip to New York” draw: The database used for the draw will be that created on the game site in real time.
Principle of the “Faster to the Ball” game: In order to access the game, you need to connect to the official “faster to the ball” website www.fastertotheball.com.

Article IV: Prizes
This game qualifies for the following prizes:
- 1st and 2nd prize: 1 trip to New York for two (2) people comprising the following services:
Length of stay: 3 days between Sunday August 28th and Wednesday September 3rd, 2011; Travel costs: round trip for 2x2 people between the home address of the winning entrant and New York + Airport-Hotel transfers. IMPORTANT: BABOLAT VS will be liable for travel costs up to a limit of 2,000 € only. Any additional costs in getting to New York over and above this sum will be at the winner’s charge. A current valid biometric passport is obligatory. Accommodation: For three (3) nights winners will be accommodated in a 4-Star Hotel located in Manhattan, - Standard Room; Meal costs: Babolat VS will pay for breakfasts only. The winner will have the opportunity to watch Andy Roddick if he is playing during the stay.
BABOLAT Products: BABOLAT VS will supply the other winners of the competition with:
- 20 BABOLAT outfits comprising: 1 pair of Babolat Propulse shoes, 1 Pure Drive Roddick Tennis Racket, 1 Racket Holder x12 Team
- 80 pairs of Babolat Propulse shoes...
Shipping costs will be at the charge of BABOLAT VS. IMPORTANT: With the exception of the costs set out in these rules, all other costs not mentioned will be at the winners’ charge.

Article V: Determination of Winners
a) Rules specific to each game:
Trip to New York:
The winning entries for the 2 trips to New York will be drawn by Me. SIMEONE, court bailiff, or one of his partners, no later than 29 April 2011 at 18:00 (French time).
BABOLAT Products:
Other winners will be drawn as follows:
For those who have generated at least 5 registered entries (valid e-mail addresses, first name, last name and IP addresses different from the sponsor’s and from each other) in the “faster to the ball” operation: Babolat Propulse 3 shoes within the limit of the 80 pairs offered as prizes.
For those who have generated at least 10 registered entries (valid e-mail addresses, first name, last name and IP addresses different from the sponsor’s and from each other) in the “faster to the ball” operation: outfits composed of 1 pair of Babolat Propulse 3 shoes, 1 Pure Drive Roddick racket, 1 racket holder x12 Team, within the limit of the 20 outfits offered as prizes. It will not be possible to combine this win with that reserved for players having generated at least 5 registered entries. In the event of stock outage on the products listed hereinbefore, they will be replaced by Babolat products of equivalent value.
b) General rules applying to both games:
Winners will be informed of the results by BABOLAT VS via e-mail and/or telephone. With no response from them within a period of seventy-two (72) hours from confirmation of their having won, winners will be disqualified and their prize will be forfeited as defined at article VIII. Prizes may not be exchanged for cash equivalent or any other consideration of any nature whatsoever and are not transferable. Nevertheless, in the event of a case of force majeure, BABOLAT VS reserves the right to replace the prizes displayed with prizes of equivalent monetary value. Prizes shall be sent to the winning participants at the home address indicated on the competition registration form. Winners authorise all checks concerning their identity and home address (postal address and/or Internet) to be carried out. All false information on identity or address will result in the winner and all of his or her entries being declared null and void.

Article VI: Legal deposit
These rules are filed with SELARL SYNERGIE HUISSIERS 13, holders of an office of court bailiffs, 21 rue Bonnefoy, 13006 Marseille. Regulations may be modified at any time in the form of an amendment by the organiser, subject to respect for the conditions laid down, and published on the game Website. The addendum is registered with the firm of court bailiffs holding the duty copies prior to publication. They will come into force upon their being on-lined and any Entrant will be deemed to have accepted the same by simply taking part in the Game, with effect from the date of entry into effect of the modification. Any Entrant refusing the modification(s) that have taken place must cease taking part in the Game. The rules and regulations may be sent out free of charge to any individual making the request in writing before the competition’s closing date by post to the following address:

A full copy of the rules may also be consulted on-line at http://www.fastertotheball.com, on the “Rules” page. The postal costs incurred in obtaining the rules will be refunded on simple written demand, on the basis of currently applicable second class letter rate.

Article VII: Disputes and Liability
Participation in this competition implies the full and unreserved acceptance of the rules. If any provision of these Rules is declared null and void, the other clauses shall retain their full force and scope. Any inexact or misleading statement or fraud will result in the participant being disqualified. BABOLAT VS shall have final say over the settlement of any dispute relating to the game in agreement with SELARL SYNERGIE HUISSIERS 13, court bailiffs. It shall not respond to any telephone or written request concerning the interpretation or application of these regulations, mechanisms or terms of the game as well as the list of winners. In the event of a claim, only a registered letter with advice of receipt shall be admissible within a period of 1 month after the results have been proclaimed. BABOLAT VS reserves the right, if circumstances so require, to curtail, extend, modify or cancel this competition subject to complying with article VI. Its liability shall not thereby be incurred. BABOLAT VS may cancel or suspend all or part of the Game if it becomes apparent that there has been fraud in any form whatsoever, particularly involving the use of IT and computers in the context of participating in the Game. In this eventuality, it reserves the right not to award a prize to the fraudster and/or to take action against the perpetrator(s) of such fraud before the competent jurisdictions.

Article VIII: Awarding of Prizes
All the particulars of the trip (transport, accommodation) will be sent to the winners by BABOLAT VS. An official BABOLAT VS representative will await the winners on their arrival. All the product prizes will be sent at the end of the game to all winners. As a result of the acceptance of their prize, the winners authorise BABOLAT VS to use their image, first and last names, postal address or e-mail in any advertising or promotional presentation linked to this game, without this usage giving rise to any consideration other than the prize awarded, for a period of 2 years maximum. BABOLAT VS may not be held liable for any delays, losses, damage, illegibility of stamps due to the postal services and occurring on delivery of prizes. Prizes not claimed from the postal authorities or returned within 30 calendar days of despatch will be lost to the participant and shall remain accrued to BABOLAT VS. Winners waive the right to claim any damages resulting from the acceptance and/or use of the prize against the organising company.

Article IX: Convention of Proof
Except in the case of manifest error, it is agreed that in regard to the game, information resulting from the information systems of BABOLAT VS have evidentiary force in any dispute pertaining to connections and the digital processing of said competition information.

Article X: Allocation of Competence
Participants are subject to French regulations on games and competitions. Any dispute that cannot be settled amicably shall be subject to the competent courts designated according to the Code of Civil Procedure.

Article XI: Data Protection
Personal information collected within the context of this game is processed in accordance with the data processing act of 6 January 1978. All persons taking part in the game, as well as their legal representatives if they are minors, have a right of access or rectification to data concerning them pursuant to article 27 of this law. Any request for access, rectification or opposition must be sent to the company BABOLAT VS.

Article XII: Literary and artistic property rights
Pursuant to laws on literary and artistic property rights, the reproduction and representation of all or part of the elements of this game are strictly prohibited. The trademarks referred to above are the registered trademarks of their respective owners.

Article XIII: Translations
These rules have been translated into English, German, Spanish and Italian of which one copy of each has been filed with SELARL SYNERGIE HUISSIERS 13, holders of an office of court bailiffs, 21 rue Bonnefoy, 13006 Marseille, (France).
